Spain: Law on Data Protection Comes into Force

On December 6, 2018, Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, was published in the official gazette. The law, which was approved by the Senate on November 21, 2018, repeals the previous Organic Law on Data Protection (LOPD) of 1999 and adapts the Spanish legal system to the provisions of the General Data Protection Regulation (GDPR).

The law also aims to guarantee the digital rights of citizens under the mandate established in Article 18.4 of the Spanish Constitution. This content has been specified in the final Title of this Law (Title X), "Guarantee of digital rights", which is composed of 19 articles.
