On December 12, 2017, the Article 29 Working Party (WP29) published two guideline papers on consent and transparency under the General Data Protection Regulation (GDPR).
The guidelines on consent provide an in-depth analysis of the notion of consent, as provided for in the GDPR, specifically Article 4(11). They further elaborate on, and clarify, the elements that constitute valid consent, as required under the GDPR, in order for data controllers to be in a position to obtain and demonstrate valid consent before they proceed to any processing of personal data. These guidelines also explore specific areas of concern in the GDPR as identified by the WP29.
